Probate

Probate is often required if a deceased person leaves assets worth £5,000 or more in their sole name.

It refers to an individual or number of people applying for the right to administer the estate. If a Will has been left, a grant of probate is commonly required, which is a legal document allowing the executor to take the authority to deal with the deceased persons assets to distribute them as set out in the will.


In cases where a Will has not been left, we can also help you to apply to the probate registry to enable you to deal with the estate. In this case, we will help you apply for a grant of representation (also known as letters of administration), and provided the grant is given, will allow you to deal with the deceased person’s possessions.


On occasion, a probate valuation is required to determine the value of a property before the grant is given. Please contact your local Kirkham Property office if this is the case and we will be happy to arrange this for you.
